PUBLIC NOTICE
PROPOSED REGULATION AMENDMENTS
Please be advised that the Division of Marine Fisheries has publicly noticed the following regulation(s) to consider proposed amendments:
Summary of Proposed Rules:
· Commercial Black Sea Bass Possession Limits: Industry proposal to amend the sub-period starting possession limits
· Commercial Scup Possession Limits: Industry proposal to amend the sub-period starting possession limit for the General Category sector for the summer (May 1 – September 30) sub-period, and amend the starting possession limit for the Floating Fish Trap sector reporting non-compliance default program
· Recreational Striped Bass Gear Restrictions: Division proposal to adopt a recreational gaffing prohibition for compliance with the ASMFC FMP
· Commercial Summer Flounder Possession Limits:
o Industry Proposal # 1: Proposed amendment to the starting possession limit for the summer (May 1 – Sept. 15) sub-period
o Industry Proposal # 2:
· Proposed amendment to the starting possession limit for the Aggregate Landing Program
· Proposed amendment to the possession limit during the summer (May 1 – Sept. 15) sub-period for vessels that hold a valid Summer Flounder Exemption Certificate
· Proposed amendment to the possession limit during the summer (May 1 – Sept. 15) sub-period for vessels that do not hold a valid Summer Flounder Exemption Certificate
· Proposed amendment to the possession limit during the final (Sept. 16 – Dec. 31) sub-period for vessels that hold a valid Summer Flounder Exemption Certificate
· Proposed amendment to the possession limit during the final (Sept. 16 – Dec. 31) sub-period for vessels that do not hold a valid Summer Flounder Exemption Certificate
· Spanish Mackerel (proposed new section 3.38): Division proposal to adopt new recreational and commercial regulations as de Minimis ASMFC FMP requirement.
2. Part 5 – Lobsters, Crabs and Other Crustaceans: Division proposal to amend the valid date of lobster trap tags
3. Part 14 – Summer Flounder Exemption Certificate Program: Division proposal to amend the rule to add a new section entitled “Change in Exemption Certificate Holder While in Confirmation of Certificate Status (CCS)”, to provide for Exemption Certificate transfer while vessel is in CCS status
